Welcome to Kizimba (“we”, “our”, “us”). By accessing or using our platform and related services, you agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use of our services immediately.

1. Eligibility

You must be at least 18 years old to use our services. By creating an account, you confirm that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate and up-to-date information when creating or updating your account.
• You are responsible for all activities under your account and must notify us immediately of any unauthorized access or misuse.

3. Platform Role

Kizimba is an online property listing platform that connects landlords and tenants. We do not own, manage, or operate any of the properties listed. All agreements, negotiations, and transactions occur directly between landlords and tenants.

4. Landlord & Tenant Responsibilities

• Landlords are solely responsible for the accuracy of property listings, images, and descriptions provided.
• Tenants are responsible for ensuring the authenticity of listings and for conducting due diligence before entering any agreements.
• By submitting content (such as property photos, descriptions, or reviews), you grant us a non-exclusive, worldwide license to display such content on the platform to facilitate property discovery and promotion.
• All uploaded content must comply with applicable laws and these Terms.

5. Acceptable Use

You agree not to use the platform to upload, share, or transmit any content that:

• Is fraudulent, misleading, or illegal.
• Promotes hate, harassment, or discrimination.
• Contains sexually explicit or violent material.
• Infringes upon the intellectual property rights of others.
• Includes spam, scams, or malicious software.

6. Moderation & Content Removal

We reserve the right to review, moderate, or remove content that violates these Terms or applicable laws, at our sole discretion. Users may report inappropriate content, and our team will take appropriate action promptly.

7. Data Collection & Privacy

We collect and process personal data in accordance with our Privacy Policy . This may include contact details, property information, and usage analytics to improve our services and ensure platform security.

8. Communication Tools

Our platform may provide communication features such as “Contact Landlord.” When used, these features initiate direct contact between users — Kizimba does not record, store, or monitor such communications.

9. Limitation of Liability

Kizimba provides its services “as is” and “as available.” We do not guarantee uninterrupted access or accuracy of listings. To the fullest extent permitted by law, we disclaim all warranties and are not liable for any damages, losses, or disputes arising from use of the platform or user-generated content.

10. Account Suspension or Termination

We may suspend or terminate user accounts that violate these Terms, engage in fraudulent activity, or pose security risks. Data associated with terminated accounts may be retained as required by law.

11. Governing Law

These Terms & Conditions shall be governed by and construed under the laws of Kenya. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of Kenyan courts.

12. Updates to These Terms

We may update these Terms & Conditions periodically. Any changes will be posted on this page with a revised “Effective Date.” Continued use of the platform after updates signifies acceptance of the revised Terms.
